Build the team and operating base your Polish business needs

A successful hire depends on more than finding a candidate. The role, engagement model, manager, workplace and onboarding process must work together. We help international businesses coordinate recruitment and operational setup in Poland so that hiring decisions connect with the work the team will actually perform.

The right plan may involve a first commercial employee, an engineering function or a technology delivery team. We agree the required capabilities, local responsibilities and support model before defining the search. Headcount, premises and administration should develop around a credible operating plan rather than independent assumptions.

Define the capability before launching the search

Technology and digital roles

Translate a technology requirement into the skills, seniority, language and collaboration pattern needed for delivery. Define ownership of architecture, security, quality, documentation and customer interaction. Decide whether you need an individual contributor, a technical leader or a team with complementary strengths. An attractive technology stack does not compensate for an unclear mandate.

Assess availability and expectations for the actual location and working model. Inclusive selection should use consistent job-related criteria and accessible processes. Our article on women in technology in Poland discusses why recruitment needs to connect with development, promotion and the wider operating environment.

Engineering and commercial teams

Engineering searches need clarity on equipment, product lifecycle, relevant standards, site responsibilities and collaboration with production or R&D. Establish which competencies must be present on day one and which can be developed. For commercial hires, distinguish account development, channel management, technical sales and country leadership rather than combining unrelated responsibilities into one title.

Agree who will evaluate candidates and how evidence will be compared. Structured interviews, relevant work discussions and proportionate reference checks help separate demonstrated capability from presentation. Compensation should be assessed as a total employer or engagement cost, including the support needed for the role to succeed.

Choose between UoP employment and B2B contracting

An Umowa o Pracę, or UoP, is an employment contract. A B2B contractor agreement is a commercial relationship with an independent business. The appropriate choice depends on the actual working arrangement, not simply a preference for a lower headline cost or the title printed on the document.

UoP employment

Plan employment documentation, payroll, statutory leave, working-time arrangements, occupational requirements and the employer’s management responsibilities.

B2B contracting

Define independent service delivery, deliverables, acceptance, invoicing, confidentiality, intellectual property and liability. Review how the relationship will operate in practice.

  • Total cost: compare employer contributions, benefits, equipment, administration, leave coverage, VAT treatment where relevant and the cost of managing delivery.
  • Business fit: assess the level of direction, integration, independence and continuity the work requires before selecting the model.

Address PIP and employment-classification risk

Poland’s State Labour Inspection, PIP, explains the characteristics of an employment relationship, including personal work, employer direction and work at a time and place determined by the employer. Calling a role B2B does not remove the need to assess those facts. The contract and day-to-day management should reflect the relationship your advisers have evaluated.

Use PIP’s employment guidance as a starting point for the questions to resolve. We coordinate the workstream with appropriate employment counsel and payroll providers; specialist legal conclusions remain with those advisers.

Settle intellectual property and KUP 50% correctly

Technology, engineering and creative work can generate valuable intellectual property. Clarify ownership of pre-existing materials, newly created work, documentation, source code, tools and third-party components. An NDA protects specified information but should not be treated as a complete copyright-transfer agreement. Employment, contractor and software-specific rules require a tailored review.

Where a transfer of Polish economic copyright is intended, the Copyright Act’s written-form requirement needs attention. Agree the relevant fields of exploitation, transfer mechanism, remuneration and evidence of delivery with counsel. Do not assume a casual electronic acceptance is sufficient for every legal formality.

KUP 50% refers to 50% tax-deductible copyright costs for qualifying income. It is not a standard discount attached to every IT job. Eligibility, qualifying creative work, remuneration and supporting evidence must be assessed. The Ministry of Finance guidance sets out covered activities and the annual PLN 120,000 limit on these costs.

Do not apply the same assumption to a contractor’s business invoices. The Ministry’s published tax interpretation explains the exclusion of this percentage-cost treatment for business income. A tax adviser should assess the relevant income and current rules before payroll or contract terms are designed around a projected benefit.

Choose a workplace that supports the operating model

Office sourcing starts with headcount scenarios, customer access, commuting patterns, equipment, confidentiality and the work that requires physical presence. Compare serviced offices, flexible space and conventional leases against the likely growth path. Engineering or specialist operations may need facilities that ordinary office space cannot provide.

Review total occupancy cost, fit-out, connectivity, access control, insurance and exit terms. Avoid committing to space before the hiring and delivery assumptions are credible. Our office leasing versus ownership guide helps structure the property decision without reducing it to rent alone.

Coordinate payroll, HR administration and onboarding

Before a start date, assign owners for the appropriate written agreement, payroll inputs, ZUS and tax administration, occupational requirements, equipment and system access. Confirm which entity is the employer or contracting party and who can approve changes. For foreign nationals, assess work and residence requirements separately from the hiring decision.

Onboarding should connect the person to a manager, an initial work plan and the people needed to deliver it. Agree language support, security training, data access, meeting rhythms and early feedback. Our onboarding guide for international employers provides a practical sequence for the first months.

We can coordinate recruitment, workplace and provider workstreams under an agreed scope, with a readiness checklist and clear handover. Where the legal entity is still being established, align the plan with company setup and launch in Poland so employment commitments match the available structure and resources.

Recruitment and operational setup questions

What determines the cost of building a Polish team?

Role seniority, specialist skills, search scope, engagement model, benefits, equipment and workplace requirements affect cost. Compare the full operating model and third-party fees, not only salaries or contractor invoices. We agree the support scope before starting.

How long does hiring and operational setup take?

Candidate availability, assessment, notice periods, contracts, immigration and workplace readiness can determine the start date. Plan the workstreams together and use realistic milestones. A signed offer does not mean payroll, access and onboarding are ready.

Can a foreign company hire people in Poland?

Potential models include a Polish entity, direct foreign-employer arrangements or a suitable third-party employment model. Employment, payroll, tax, social-security and permanent-establishment consequences differ. The appropriate structure should be confirmed with qualified local advisers before work begins.

Which local requirements must be ready before someone starts?

Requirements depend on the role and engagement, but may include written terms, payroll and social-security arrangements, occupational health and safety, equipment and lawful system access. Foreign-worker permissions require separate checks. Assign each item to an accountable owner.
